I waited in all day for a parcel to be collected from a company called Hermes who acted on behalf of webuybooks.com. It was a total farce there is no way I would have missed them they claim that collection was attempted that was a lie. I got through to CEO team and they are refusing me compensation as they say my contract is with webuybooks.com I don't believe that surely they have to take responsibility I don't have an issue with webuybooks I have an issue with them.
I have had probs with hermes.....i will not use them again and i tell this to anyone or company i purchase goods from. they either use another delivery method or lose my business.
jno is correct.Your contract is with webuybooks .It is their responsibility to sort out collection or delivery problems. Get webuybooks to rearrange collection. Or take the parcel to a Hermes drop off point. The drop off point will accept the collection label. I have done it several times.
I've had deliveries marked as delivered when they weren't - and was told that the driver sometimes does that!
They are right when they say your contract is with Webuy. This applies with any delivery company - your contract is always with the company you buy from, not the courier.
I sold an item on eBay and used Hermes to deliver it. The buyer claimed to eBay he had not recieved it,despite Hermes tracking saying it had been delivered and actually naming him as the person it was delivered to, eBay immediately rejected his claim . But then he complained to PayPal who took the money off my account and despite the tracking refused to refund me , they said it could not be proved he had recieved it.

Even though your contract is with the Seller, what can one do about these dishonest Couriers ? We all seem to come across them occasionally. duh !
When you purchase something through distance selling the vendor is legally obliged to ensure that it gets to you in good order. If it doesn't, it's the vendor who must compensate you (even if the carrier admits that they lost or damaged it). The vendor is then free to pursue the carrier for compensation in respect of their own loss but that's totally separate to the contract that you have with the vendor.
