Petrol Payment
Kiosk member looked as I was filling my car and authorized my pump. As I am hard of walking so I sent my grandson in to pay. Was told to go and pay myself. Being disable this was difficult. As I am old enough to purchase the fuel, it was my car and I would be using the fuel why couldn't I give my money to pay for it? My grandson was not gaining anything. Would the law prosecute anybody for this transaction?

On 1st October 2014 there were major changes implemented when the Petroleum (Consolidation) Regulations 2014 came into force.
"No person under the age of sixteen years is to operate a dispenser on dispensing premises. No person is to supply, or allow the supply of petrol to a person under the age of sixteen years. Both these new offences carry an unlimited fine in the magistrates court."
and which letter may I ask - was the kiosk owner sticking to?

if granny or graddy put petrol in the car ( "I filled it" ) then I am not even sure that the grandson can be said to be attempting to pay - he is rather obviously the agent of the person in the car innit ?
[I initially thought you had driven away on the grounds you had lawfully offered to pay and it had been refused - not that is MUCH more interesting and kinda happened to me]

The cashier could be in a difficult situation knowing that the transaction is being filmed by CCTV. All that could be seen is that he/she has accepted payment for fuel from a child which is illegal.
No different really to sending your grandson in to the shop for your fags whilst you are clearly stood outside waiting for him.

but it is me in a fight on a hospital corridor - golly didnt I have fun in those days ?
The old system I was 'caught' under - petrol pump with card. the pump allowed filling and then didnt take the amount from the card. I was written to by the Chief Constable no less saying it looked as tho I had bilked but he knew what ..... go to the petrol station and pay and they would forget all about it
The card apparently clicks in and they take 1p off ( recorded at 1605h) and then the rest is taken off. I checked this before raising hell at the station - and indeed my card had been recorded but not charged finally - showing I had intended to pay
(Back) at the gas station, I demanded the video and said it showed I had an intention to pay and so why ...... were they telling the chief constable that I had stolen it ? when they knew I hadnt
Queue of ten others whilst |I was yelling "Making false statements about your customers may be very expensive indeed !" and served the data subject request on the hapless till clerk - 'you have been well and truly served!' She scuttled away like a beaten cur leaving nine in a queue
I also spoke to the owner who was finding all this Very Funny Indeed - and was also of the view that the CCTV wasnt under his control and he didnt know whose it was ! (more giggling)
I also asked whether money changed hands when he told the chief constable to contact me because I had stolen petrol ? at which point he realised that things werent going his way at all -and said it wasnt him it was the clerk. I also mentioned that using a CCTV to prevent theft was under different statutory rules to using it to collect debts.
I think I also dragged in: using a chief constable to collect his debts was an unlawful use of public funds - a point I think I made to the chief constable separately. who also said "narfin to do wiv me guv: I am up for my sirship I am !"

and so as you can see - the Chief Constables have decided that they are NOT debt collectors for lazy and stupid garage owners after all.

Completely different. The petrol station did not supply the fuel to the grandson; he never had possession of it; as Peter says, he was simply an agent making a payment. It was pumped by grandad into the car.
A sad case (ever the more frequent today) of common sense and discretion being chucked out the window. I could not see any court convicting the petrol station of contravening the regulations. More than that, if grandad had simply told the cashier (via his grandson) that he was unable to make it to the till and that if they wanted payment other than via the boy he would provide his name and address so that they can contact him, there is no court in the land that would convict him of making off without payment.
