I take it the piece of garden you want comes up to your window which will eventually become a patio door? If so you could first of all put a few pieces of hedging around the piece of ground you want to become yours. A few pots as well and see if anybody says anything. Then if nobody does, slowly progress from there. Don't spend money on patio doors until you are...

I should think it's a no no. Communal means being shared by everyone who lives there.
If all tenants in one block of flats decided to do this, there may not be enough garden to go round!!

Cloverjo. I have only been in my property for a year and the other flat looks as though the fenced off area has been established for a while. How they gained access, I don’t know. It just seems a waste of a piece of land that nobody uses, when I am willing to even purchase a part of it and enhance it. The other blocks on the estate have rear gardens but it seems they may have run out of funds when it come to my block.

If you want to make some this unused area look attractive then good for you. A tree in each corner would look good. You could always pay a bit of rent I suppose although if you are spending time and money on making it look nice I don't really see why you should. I wish this wasn't in Law, I feel guilty:-(

We can't advise how to gain access as we don't know the details. You are in a much better position to answer that. I think your response to bednobs (and others) was unneccesarily abrupt.
If the council can't help regarding your wishes then either forget it or do what you want by stealth until someone tells you to stop. Or get a solicitor if you want to find a way of doing it by the book.
