pensions and divorce

I have had a non contributary pension for 16 years with the company I work for. My wife has left me after only 18 months of marriage. we had lived together for 10 years. Will she be entitled to part of the pension paid for 16 years or just for the time we were married. I am 34 years old and my wife does not have her own pension.

Well she is your wife and therefore with the new laws she will be entitled to some of the pension. If you do not agree on the split of your assets then the Court will decide. Whether they will look at the time you lived together as part of the 'marriage' I am not sure. It all depends on what she contributed during your time together and what you are doing about the house and equity and any other marital assets. So sorry it did not work out for you, and hope you can sort out things amicably without getting into expensive lawyers fees.

I doubt this because you are not collecting your pension yet. Maybe if you were, things would be different. Do not mention the subject to her and she might not think about it. By the time you collect your pension you will of been divourced a good few years.

Well when you get divorced the pension sharing order is made long before anyone starts taking their pension, but as you say - she might not know about this, but you can be sure that if she seeks legal advice then her solicitor will be very aware of it!
