A friend was recently charged with ABH with GBH intent. This was a domestic although my friend was charged,he punched and kick the victim and threated with a knife and press the victim down on the bed.The victim caught their left thumb on the knife and it was cut.The victim ran outside screaming and my friend stand there shocked and bemused. My friend has never been in trouble with the police before until now.It is total out of blue for him. He very remorseful about this. The victim is his partner. The question is: what is the worst and least could happen to him?
No best answer has yet been selected by monkeymagic. Once a best answer has been selected, it will be shown here.
For more on marking an answer as the "Best Answer", please visit our FAQ.The absolute worse that could happen is 15yrs inside for GBH Sect 18 wounding with intent.
However, as there appears to be a degree of mens rea (guilty knowledge) on the facts you have presented there could be an attempt murder which can hold life.
In all reality if he pleads guilty and the wound is not too damaging he will get 2 year suspended 500 compo/costs and maybe forced to go on an anger course.
The old days of a 'domestic' being ignored by the police and the Crown Prosecution Service are over and charges can be brought against him, even if his victim decides to withdraw her statement. If he wants to avoid prison, he needs to discuss his options with a solicitor.
I suspect your friend will have a criminal record by the end of any court case, but it could vary between a conviction for GBH with intent, which I believe can be 15 years (Very unlikely), or a suspended sentence and a fine.
The fact your friend punched, kicked, threatened and then injured his partner with a knife is a chilling thought. I pity any stranger who upsets such a man.
