my daughter is engaged with a three year old son, living with her boyfriend,the relationship is now over,she has told him she is leaving and he said she can go but has to leave the boy,where does she stand leagally?
im slightly confused by the question, is the child the boyfriends son - she doesnt need to leave her son behind and if she and the ex boyfriend sort out an access greement then the courts wont need to be involved
Of course she shouldn't and doesn't have to leave her son behind - why on earth would she??
He could get a parental rights agreement drawn up giving him access and visitation,or if he really wanted to be awkward he could apply for residency but there is no way he can make her leave the child behind with him.
As far as i am aware he can not make your daughter leave the child. If the child is not the boyfriends he has no custodial rights over that child whatsoever.
If the child is the boyfriends, as they are not married , again he does not have automatic parental rights, he has to apply for them. Either he can not tell your daughter to leave the child behind. Howevere as always with custodial issues, consult a laywer asap or atleast the Citizens advice bureau
