A bridleway has been used as a vehicle access over common land for at least 40 years to access mountain land, part of this mountain has a crofter's cottage which has recently undergone change of ownership, the new owner is attempting to stop access to all vehicles other than his own, can he do this or is there a form of right that can be gained after a certain period?

you will have to check with the local council,they will have all the info on the right of way etc.

You could also inspect the Title documents to his property by using Land Registry Direct. It costs about a fiver but you can inspect both the Office Copies of his Deeds and a Title plan.

When he bought the place his solicitor would have asked the previous owner about rights of way and they may have misled him.

if it's common land I thought anyone could go over it you cant stop horses going over it as it's a bridalway but if it;s common land \ right of way you can go over it.
