Compensation for damage to property

This is our first year in this house. At the foot of the garden there is a strip of land .owned. we have discovered by a property company. This land has such virulent brambles, that they are pushing over our fence. We discovered this when we cleared the garden recently. Having found out the name of the company, we have been in touch ( 3 times over the last 4 weeks) and they have finally agreed to cut back the brambles. That is good news but It is all too late for our fence and though they admit the land is theirs, they refuse to compensate us for the replacement of the fence - it is 6` high and 24` long. Quite an expense. We have said we should be happy with a goodwill gesture from them but no dice! Are we within our rights to ask for this given the circumstances? Does anyone know? Thanks in advance for any advice.

why should they pay for a new fence if its nly pushed it over? Just prop it back up!

Bedknobs, we can`t prop the fence up against the pressure of the wretched brambles - we have tried. They`ve gone mad after all the rain. O`Reilly many thanks to you for your suggestion. Elly.

i meant wait till the cut them down and shove your fence back up again -

A neighbour cannot:-

1) paint or stain or render your walls or fences

2) Attach anything whatever to your walls or fences

3) grow climbers or ivy up your walls or fences

4) lean anything or pile soil etc against your wall or fence

5) allow balls etc to be kicked or thrown against your wall or fence

All damage caused by any of the above is the responsibility of the neighbour


If the neighbour argues tell them they can check this is the law at any CAB or Solicitors and that they need to think how they would like you doing the same to their car or property
