criminal charges prosecution
After months of verbal and mental abuse from my neighbours they are about to move to a new address. for months they have been causing criminal damage to our fence. we have video evdence of this. We want to prosecute them for this and the cost of a new fence, would we be better asking the police to convict them or do it privately, also are we ok to do this once they have moved. Obviously we were not in a position to do while living here, and can they be prosecuted for not disclosing this when they sold. Please dont say speak to them as we have tried and the woman is very very volatile.

They should by law disclose any bad relatioships with nieghbours at the time of the sale of the property, and if they havent already done so, I'm quite sure your new nieghbours would like to hear it from you, as they may have some claim against the people that sold the property to them, this may give you some satisfaction at a later date while you are errecting your new fence,

i think you have got it confused a bit ..you must declare dispute you have had, but as for the new people suing someone ... why? they are left with the nice neighbours, not the horrible ones whose house they are moving in to. living next door to nrmal sane people does not make your house go down in value!

that what i mean too ... if, for example this poster had had loads of trouble with the neighbours and then wanted to sell their place and failed to disclose the trouble they'd had then the new buyers could potentially sue them becaus the huse isnt worth so much with crappy criminal neighbours. if its the bad ones going away however, as in this casse, there is nothing really to sue for for non disclosure cause they havent lost anything, just gained lovely new neighbours in lam143!
It must obviously depend on what area you live in because our neighbours, (who were moved here by the council because they had a dispute with their former neighbours) did damage our porch one night and it was the police who suggested that they have a word with them saying that they either pay us the cost of repairing the damage or they will be charged by the police with criminal damage. They paid up and no charges were brought. Why didn't you call the police when they did the damage? What they did is illegal.
