Painting neighbours fence

My neighbour has just put up a new fence (his responsibility) and I wish to paint it forest green to match my other fences. It was this colour before he renewed it. I am told he is within his rights in his refusal to let me do this. He says it amounts, in law, to criminal damage. Is he right?
