It seems there is no by law preventing a householder having a fire in his garden. You can complain to the council if he is a persistant nuisance with smoke drifting into your garden as this can contain harmful toxins.
For a twit like this to have a fire so close the the boundary probably means he needs to speak to a mind shrink.
If your garden is in excess of 40' wide would you position the incinerator on top of your neighbours fence so that he can inflict his smoke, toxic fumes and discomfort upon you? If the answer is YES there are more selfish ignorant people about than I first realised.
