my husband was driving my car which i have insured for me as third party, my husband is fully comp on his ins. a few weeks ago someone drove into the side of us so we exchanged details etc, the driver was driving a company vehicle and they wrote to us saying that they were not admitting liability and that we drove into him. we instructed a personal injury lawyer as both my husband and i had to attend a&e for whiplash. my husband does not want to claim from his own insurers (3rd party) - alhough we did inform them - as it was not ou fault and the car is a complete write off. as i needed the car for work i had to take out a bank loan and purchase another car. Our solicitor has now written to us say that an engineer arranged by the third partys insurer has been and inspected the car and written it off and is offering us a payment of �450 - P reg metro. I have tried to contact the solicitor but cannot get hold of him as im unsure who the third party is, is it my husbands insurance or will it be the guy who banged into us? If it is him then that will mean they are now admitting liability, could anyone shed any light on this for me please thanks
The 3rd party is generally the other insurer(person that hit you), if his insurers have arranged for an engineer to inspect your vehicle it doesnt necessarily mean that they have accepted liability, they could just be speeding the claim along and seek expenses from your Insurers if the claim is paid
Ask your solicitor for the 3rd party insurers details and call them directly for an update.
Every insurance company works differently and there is no set rule on claims procedures.
Can i just check- was your husband insured to drive your vehicle- either as a named driver on your policy or does his own insurance policy also cover him when driving any other vehicle with policyholder's permission.
I'm not clear on something else too-- who has appointed your solicitor- have you done it yourselves or has one of your insrers appointed them.
