Conditional Discharge - When is it Spent?
4 Answers
I was given a 12 month conditional discharge in March 2007 for stupidly getting caught with a small quanity of drugs. The following website tells me that it should be consifered "spent" by now as it states "1 year or until the order expires
(whichever is longer)" and it has been more than 12 months.

I have just accepted a new position after telling them that I have no unspent convictions but I have now seen another web page that says it is a year from the end date of the order. Please can someone help me as this is a really good career job and I dont want to lie to them as I know I will get checked.
Will this show up on just a basic disclosure (I am having basic disclosure, not CRB)?????

so i just stumbled on your question
if you read the site properly it says the rehab period is from the date of conviction at the top start of para 2 "A rehabilitation period is a set length of time from the date of conviction"
so a 12mth cond discharge as i read it is spent after 12 months from the date of conviction
a friend of mine who is a probation officer also reads it the same hope that helps :)

I can confirm that the rehabilitation period for a conditional discharge is 12 months from the date you were charged. Thanks for your replies guys.
In the end I contacted a very helpful charity who confirmed this for me. Its very useful for anyone with a question about a criminal record.

"Each year, the helpline deals with over 30,000 enquiries. The most common enquiries are about dealing with a criminal record, and how to find work and somewhere to live.
The helpline is on 0800 0181 259 (freephone) or 020 7840 6464. "
