Return of personal possessions
2 Answers
I split up from my abusive and violent husband this time last year and ended up having to leave the property with my daughter and about 3 bin bags full of clothes as that was all I could fit into the car. I am in the process of getting divorced obviously and my solicitor is sorting out the financial side of things (house and contents) but despite repeated requests for the return of our personal possessions he refuses to return them. He has kept the entire contents of the house plus my books, cds, dvds, photos etc. My solicitor has told me I can take him to court but I can't really afford to do so. He lives 300 miles away so can't really just pop round to take them plus also because of the domestic violence would be too scared to anyway. i know he is doing this just to irritate me....and it's working!! Anyone got any advice please? Thanks.

I would think writing to him would be the best way - you could put at the bottom if you dont hear from him you'll start court proceedings. Alternatively - would you be happy with a cash settlement in lieu of the items? you culd ask him for that instead (via letter/solicitor). Otherwise i would guess they/cash could be considered within the divorce settlement.
Lastly, you haven't had the things for a year: is any "thing" worth the hassle over?
