ive noted some trees have been felled on a verge on the side of road that leads back onto a closed off road due to by pass. these trees have been down for a long time, is it theft if i was to cut them up and take them for fire wood

Yes it is - they belong to the owner of the land. Whther he will notice and if he does care is another matter.
Yes,it's theft,because they are not yours,and you don't have the permission of the landowner to take them.
Is it theft if you pick up something that someone has thrown away, that they dont want?

Of course, the problem is knowing for sure that its actually been discarded.

If its on the roadside you could ask the Council.
