Under Age Sex

Does anyone know how likely it would be for a 16 year old boy to be prosecuted for having sex with his 15 year old girlfriend? Their relationship lasted for well over a year and they were having sex when they were both 15.

the irish position on abortion is in my opinion disgraceful
they even attempt to stop folk leaving the country for abortions
ive read of such cases in the press
and also their antiquated ideas still lead to abortion ships off the irish coast i believe?
or has this situation changed?

thank you pink, i think you know more about this area as you work for social services, and it wouldn't do you much good not knowing the law! I've already done criminal law and sex offences during my LLB, i got a 1st with distinction. But there we go, legendis seems to be spewing information from the internet and does not consider the whole of the facts.
firstly every irish citizen has the right to travel for an abortion. That is in the constitution. Some difficulties emerge for those children who are in state care under a court order and they require courts permission to travel for an abortion which is generally forthcoming.
Secondly most people answers relate to articles in the news papers media etc it is not solely based on direct practice. Those and many other cases dont hit the headlines so go unreported

corbsy tho pinky may be correct about eire and teen sex pregnancies
their record in sexual abuse in eire is to say the least pathetic.
it took the best part of 20 years to get a comission to investifgate the sexual abuse claims against the christian brotherhood .
claims which surfaced back in 1980 yet i think it was the late 1990s before bertie ahern and the irish government started a commisssion to investigate child abuse
and lest not be under any illusions what scooby is talking about is consentual sex not child abuse
pinky that is something that ireland is still coming to terms with i reckon
though i didnt go to uni and may be uninformed
i have sytayed in eire many times as you know and have met many `people both sexually abused ad physically abused by both priests and nuns who were by all accounts above the law
no matter what it may have said

is child abuse and underage sex a different topic?
no
because im sure yyou
being a legal whizz
willknow that sex between even a 50 year old man and a 15 year old is classed the same as if they were both 15
i believe that was the defence that jonathan king used
he had underage sex with boys
but he isnt classed as a paedophile , tho theres no legal term calling someone a paedophile in the uk.
i believe tho i may be wrong?

I mentioned assisted suicide, merely as an example of cases where offences happen but are not necessarily prosecuted.
And my answers do not relate to popular newspaper reports. My answers relate to many years' experience. I retain one area of specialist prosecutions - child sex offences.
Granted Corbsy, it can still happen, but is in my view, unlikely.

religious abuse is everywhere there have been so many inquiries on child abuse in england that are current we only have to think of baby p. Clerical abuse in ireland dates back
however i am not convinced 15 year olds are capable of fully consenting to sex as thy are not always mature enough.
The law is meant to be there to protect children and when it is not upheld this is what creates gaps that allows children escape the system

i was making a comparison between eire and the uk
bearing in mind pinky is in eire and was comparing the uk to eire first
remember you could saty 300 yRDS AWAY IN THE NORTH OF IRELAND ANS HAVE TOTALLY DIFFERENT LAWS
THATS MY POINT
AND AS I SAY IS CHILD SEX ABUSE AND UNDERAGE SEX THAT DIFFERENT?
IF SO WHATS WORSE AND WHAT IS THE LESSER OF THE TWO CRIMES ?

Corbsy you seem to want to argue for arguings sake
its highly unlikely that a prosecution will occur
as for a private prosecution that can be brought seperately but isnt by the state and we are talking about the law and the action of the authorities not individuals
pinky im sorry eire is a different case regarding child abuse .
the state were complicit by not doing anything for so long.social workers wouldnt have been able to do anything such was the power of the church in ireland
im sure you mustve heard of many cases wheer the abuse was reported to the social services and nothing was done
im not blaming the social workers like in the case of baby p where i would balme them
in eire the staet wasnt interested and i believe it was mmade very difficult for anyone to investigate or help the victims
weve all seen the magdalene sisters and seen how adults were allowed to be treated by the church
children had even less rights
i believee since the late 90s there have been great strides made
but they shouldve been made ,many years before
do you concur or am i perhaps exageratting the situation?

legend - from the mid 70s to 1983 I was working on a volunteer basis with a charitable hostel in Birmingham that was specifically looking after girls and women from Southern Ireland that had come over for an abortion. Some of those girls were very young, and some were married women.
I was quite shocked by the numbers, at first, and there were similar hostels in London, Liverpool and Glasgow.
*apologies for going off topic, scooby*

dont agree with your version of abuse in ireland and would be all night explaining
basically changes occured due to constitutional provision and place of children being those up to 18, a number of reports and legislation and the development of social services.A move towards state providing care as opposed to religious .also better training and education of staff, All social workers have a Masters. I couldnt work in the english system

i cant help it, legendis im not wrong, read the full post please! And dont force your opinions down our throat! Consider every situation, consider all the facts then assess!
I cant help it, but legendis your so ignorant of your own stupidity its unreal! You shouldnt be allowed to comment on forums, you have no legal expertise nor knowledge, i suggest you read up on your law, then maybe you can give a well informed opinion!
I hope scooby, that it doesn't go any further!
