parking in a bus stop

I was recently given a ticket for parking in a bus stop. The stop was marked out with broken yellow lines, there where no other markings on the roadside or kerb, also the half hourly bus had just left. Would I have a case to appeal ? To add insult to injury the parking attendants had coned off three spaces so they could park their car !

An appeal against a PCN more often relies on the wording on the PCN itself rather than the physics of the actual parking. Post your question here.

You will be asked for a scan of ALL the PCN, that includes front AND back of ALL the bits of paper you have, so be prepared.

This is breach of Rule 243 of the Highway Code which basically states that you must not park at various places, a Bus Stop being one of them.

I cant see how you would be successful at appeal, as it appears there were no mitigating circumstances.

No sympathy for you, but if the attendants realyl are coning off spaces for themselves, then they deserve to be reported.

Whatever possessed you to park at a bus stop in the first place? Did you honestly think that it was a suitable and permissible place to park?

And, you make it sound as if the parking attendants chose to cone some of the area off so that they could park there as well. Let me ask you this:
1. Was their car there when you drove up and parked? OR
2. Did they arrive after you and simply parked there while they dealt with you?

Sounds like you were "banged to rights", got caught and are desperately trying to make out a case for why you shouldn't have to take what's coming to you!

Thanks for the input. The parking attendants arrived as I was locking my car, and I had actually drove up to the spaces before I noticed the cones and then reversed into the bus stop. They moved the cones to park. As I see it, it is safer for me to use an empty bus stop than walk an undetermined distance with two children along a busy road. I then had to collect a third child. So if it is alright for them to park, it must be alright for me.
Before anyone tells me to use public transport, the bus is half hourly, takes 40 minutes (10 minutes by car) and requires a change of bus. It would cost me �3 each way plus the childrens fare.
I have checked the RTA and supporting information should be on the roadside, ie, clearway. there was'nt any.
So I am going to give it a go. It will make me feel better, win or lose.

Why do you think you have the right to park in a Bus Stop? During the years that I was unable to drive to to my illnesses, I lost track of the number of times I was unable to get onto a bus because the bus couldn't get close enough to the kerb for me to get on. The inconsideration of people never fails to amaze me and I sincerely hope that if they are ever unfortunate to suffer as I have, that they too will be unable to get on and off buses. People may call me harsh but I have been there and suffered and hope that the drivers who caused me unnecessary inconvenience get their come-uppance in due course.

What the bus timetable has to do with you illegally parking I have no idea. As a bus driver, people parking in bus stops is not just a pain in the butt but also prevents the bus form pulling up alongside the kerb, resulting in situations such as osprey has suffered.
Inconsiderate drivers are blight on other oad users and you deserve your ticket. Pay up, shut up and don't do it again

Well, I do not think I will be using this site again. I thought it was about information and advice; instead it appears to be a platform for small minded people who have nothing better to do.

My advice to anyone in similar circumstances is to fight your corner and be aware of all the facts.
BUT. I do not advocate inconsiderate parking, drivers park sensibly. Please.

Ok small and big minded people on this site, lets deal with the facts. There are different types of "bus stops" and there are situations where it is legal to park in a "bus stop". In parts of the UK there are community spaces for parking in high traffic or constricted road width venues. In my own case there is a bus stop at the end of my road, that is at the corner of 3 roads and a set of traffic lights.

The situation here is that bus stop has broken yellow lines around it, and is at the end of a permit parking section of a road. The law is very clear, you are entitled to park in bus stop, provided it is not a "restricted" bus stop. Restricted will be marked by a solid yellow line at the entrance to the spac and normally marked with either a thick yellow line, or double yellow lines.

Where the bus stop has a broken yellow line around its perimeter, and no single or double yellow lines, it is not a "regulated" bus stop, and thus is treated like an unmarked piece of road. This is also known as a community bus stop, or pull in.

The act is the 1991 Road Traffic act, and this issue is covered under the PCN 49 part of the code around enforcement and adjudication.

So to be clear, check if it is a "regulated" bus stop, then you know if you have an appeal.
