Assault Charge
9 Answers
I have been involved in a fight outside a pub, where i punched a male once in the face after being provoked. I was arrested and charged with assault and released from custoday within 4/5 hours.
It has now became apparent that the man I assaulted now has a broken ankle as a result of him falling to the ground.
I have not as yet made any full statement of this incident, and have been advised to await a letter from the Proculator Fiscal before actioning a solictor etc etc.
I'm looking for information on what types of fines i am likely to encounter and what amounts of compensation can the victim claim from myself directly.
I have previously been convicted of a similar assault in 2002, where i recieved a 400 fine as a result. Would this also affect any conviction / fine which i may recieve.

I kicked a tram inspector in the ribs, It turned out I had cracked his ribs, he then left his job bcause of the stress. I was initially just given a warning. The reason I kicked him was bcause he grabbed hold of me and tried to restrain me, 2 wks later I got into a similar incident wherby I smashed my hand through a pub window after an argument. I was arrested, took back to court, It was adjourned for character reports, and I was then later bound over for 12 months to the tune of 50. Bcause you have been in trouble previously this will go against you, however, my suggestion would be to say that you were acting in self defence and that whilst in the toilet or somwhere cctv less, he had pushed you into the door or on the floor etc,, self defence covers a mutitude of sins. In relation to fines etc, it wasn;t intentional that he broke his ankle so I would say that you may get bound over or a community order.

Yes, I'm well aware of that but most of the legal questions I've had an interest in just happen to have been subject to English law, that's all. Nothing more to it than that.
And the title Procurator Fiscal is peculiar to Scottish Law, not English, hence the reason I asked.
Besides, how do you know I'm not Scottish?

twenty 20, I see you have plenty to say but so little that actually counts. At least I can admit to my mistakes, as can kev above. I take it you've never made a mistake, or is it that you just can't admit to them. Admitting you have a problem is the first sign of recovery. How do you know that Kev wasn;t acting in self defence???Hh has indeed said he was provoked so somthing obviously happened. Get a life twenty 20. this is the real world, not Disney world.
