I split up from my husband 3 years ago. He gave me 100k. I then met someone else. We now have a joint mortgage. I have 2 thirds, he has 1 third. I put 100k down. The house was 172k two years ago, so mortgage was for 72k, repayment for 2 years. The mortgage has recently changed to another repayment mortgage for 68k ish, 2 years. My partner has not paid nothing towards mortage since March. I have been paying it solely. I am very bitter and annoyed. I now want him off the mortgage. I am concerned that if we split up he could take some of my 100k which I don't feel is fair. So my question is what can I do? Where do I stand legally? Even if I stayed with him and let him live here how can I get him off the mortgage or at least change the amount to 3/4 in my favour and a 1/4 in his favour.

you can only do all of that changing with the partners and mortgage lenders permission
You'd also need to buy from him - or persuade him to give you - his share of the property.
How is the house a third his if the entire deposit was yours?
