Made Redundant and job re advertised 2 months later !!!!
7 Answers
I would really appreciate any guidance with this, violins at the ready..
Myself and 9 Colleagues were made redundant from a large Estate Agent in December 2009 , we worked under the umbrella of the Estate Agency for a small Mortgage Company, and our redundancy letter says that due to market conditions the company could not continue. We didnt receive any redundancy payout other than the statutory minimum for people that have worked there over 2 years. Nobody worked there less than 1 year..
We have now discovered that the company has declared on Mortgages Strategy that they made profits of 54.1 million, and they are now recruiting 90 new Mortgage Advisers !!! The most annoying part is our managing director that laid us off is now "head of mortgages" for the estate agency.
We are all considering completing the relevant forms and sending them to HR and ACAS employment tribunal, Are we right in thinking we have a valid claim? Many Thanks

You have a good case wendy and I would pursue it through ACAS. It won't cost you anything and they are are very helpful. I had a job ( management ) where I was made redundant after 11 years service .
Ok I got redundancy pay but my job was then re- advertised as " no experience necessary ". And I had, had ,11 years of experience with paperwork to prove it .
Which is where I had them over a barrel .
This is several years ago now and I'm now retired but at the time I thought it worth pursuing .I did indeed have a case and they settled out of court ,mainly, I think to avoid publicity . I would get in touch with ACAS asap . Keep all paperwork as advised and I hope you have a positive outcome .
