For anyone interested, I thought I'd let you know - we wrote to the HMCS re previous post, and they have replied stating that giving the circumstances if my partner attends the court to sign a statutory declaration the fine will be quashed.

I'm so pleased as I thought it was beyond hope. Thanks to all that answered with advice
