he's been in his house for 2yrs now,but thehouse needs a few things done to it in the way of repairs. but since before christmas he letting agent for the house told her to withhold the rent,this she done.also she was told that she could get someone in to do the repairsand pay them out of the rent owing.but she has just been served an "EVICTION NOTICE" to get out of the house.now my question is!! from the eviction notice does she owe any rend on time over the date of eviction,if you know what i mean. please could i have all your replies as soon as,because she's there now on borrowed time. thaNKS FOR YOUR TIME IN READING THIS.
i absolutely can't believe any reputable letting agent would tell her to withold the rent! Why would they do that? What did she think would happen if she didnt pay the rent?
Did she let the landlord know that the repairs needed doing? Did she ACTUALLY use the witheld rent money to effect repairs? were the repairs essential (ie big gaping holes in the walls, or just things she would have liked to have been done?
Yes, bad move not paying the rent - it puts her in the wrong. Not surprising she gets an eviction notice.
I'd be really surprised that a letting agent advised her to stop paying rent as no rent means no monthly commission for them.
And, yes, she will owe rent up until the day she leaves, whether that's by being evicted or leaving of her own accord. If she fails to pay all the rent due then the landlord will probably take her to Court.
You can't be evicted without a Court order, and there is a procedure that has to be followed. If they are not following it, any eviction would be illegal. Go to your local CAB or local Council for advice about this.

thing is now she's had a guts full of it all.
so now she has found a new home and is going to move.
THING IS NOW!!
as she owe's 2 months rent @�400 per month.
she has been told by the letting agent that her BOND of �400 will cover 1 month,if she pays the other month she will give her a glowing "REF"but my friend has already told them what the sittuation is.

The date of service of the eviction notice is irrelevant. She is liable to pay rent up to the date she moves out (even if it is after the eviction date specified in the notice) OR - if she moves out before the date specified - the date the notice specified as the eviction date.
Unless there is a Court order, the eviction notice is probably illegal and she could ignore it and stay there. So the question of the landlord having to give her time to move out shouldn't really arise. However, as she has decided to go I would have thought agreeing a date should not be too difficult. If the notice has been served under a Court order then the date will be definite and cannot be altered unless the landlord agrees.
