Driving without Insurance

Hi there, just looking for some advice please. My brother was asked to drive his flatmate's car whilst the flatmate was away, to keep it running ok.
Unfortunately for him, he had to turn the lights on and didn't realise but the fog lights came on. (it's an old car so there's no auto whatevers)
He was stopped by police and given a grilling. After explaining the car wasn't his, he was given 7 days to produce proof he's insured to drive the vehicle, otherwise he faces court action. It turns out he isn't insured. Bummer!
Just wondering:
1. What is the likely punishment for the above offences?
2. Do you think it's his or the flatmate's responsibility to make sure he's covered by insurance?

2. fog lights only come on with a switch so it probably had been left on by the owner.
3. driving with no insurance- fine and a ban maybe.
4. your brothers fault for not confirming the insurance details with his friend first.
