My brother has been stopped by the Police. He was driving a van with No Insurance, Tax or MOT. The van was impounded and now scrapped. What can he expect to get in court?
I know what your thinking. I think he should be thrown in jail he's old enough to know better. He has lost his job because he needs the van to work.
No certainly not jail that's costing us that pay our tax and insurance and mot and licience to keep him there. Hefty fine and banned and re sit driving test.
I'm not condoning his actions in anyway. He's nearly 50 and has only got his licence back this year after an 18 month ban for drink driving. His life is a mess. He is fighting alcoholism. I have told him that I would report him if I knew he was drink driving again. He started to pick himself up becoming self employed as a market trader. Well thats gone now. I am trying to get him into counselling so he can get help to get his life back into prospective.
How long would the ban be for and any ideas on how much the fine?
It seems you are trying to do him a favour by trying to keep him straight but I don't think you will suceed .At 50 he should have more sense if he has already had his licence taken from him I would be none surprised if he gets a longer ban this time. Good luck if you can sort him out.
A bit late, I know, but a correction or two to the earlier answers.
The usual penalty for a first offence of No Insurance is a fine of about �250 and six points. It is unlikely to result in a ban, tough the fairly recent drink-driving ban may influence the magistrates. You cannot receive both a ban and penalty points for a single offence.
No MoT is a fine only (50-�100) and cannot result in an endorsement, points or a ban.
Thanks for that New Judge. So you think hewon't get banned? He was going to but another van but has put it off as he thought he was going to loose his licence.
A sorry tale, but still no excuse for no documents, we all have to fork out for it whether we like it or not. I wont say how miffed i would be if he pranged me then shrugged when I asked to see his insurance details.
