Car Ownership
36 Answers
I bought a car in November as I am learning to drive. The car is in my name, so too is the log book and the monthly payments are coming from my bank account. The car weas jointly insured but is now only insured in my ex-girlfriends name. My ex-girlfriend has the keys to the car. What can I do to get the car back?

Talk to her & ask for the return of the keys, advise her if she still will not hand them over you will be contacting the police. ( Does she have any money involved in this car?) If so, different situation.

If your name is on the V5 then the car is your property unless 1/2 owned by her or a Finance company, if no HP If your G/F has any money that she paid WITH YOU as a dep then she has right of part ownership, when the car was bought what is stated on the purchase details? your name? her name? Joint? I would try to sort this out amicably, If that does not work explain that you intend to see a solicitor.
Everything is my name, deposit, car finance. Insurance is in her name as she has driving licence and I have yet to pass my test. Will try to sort it amicably but want to know where I stand as after I pass my test I will need a car for employment and dont want to take out more car finance. I am also concerned she will not pay the remaining 52 months of this HP for the car
Why is it you expect her to pay for your car? she may have the licence/Insurance to drive but the car is (I believe, yours) You still have not answered the Qs, did she put ANY MONEY TOWARDS THE CAR? never mind if she has bad credit, is she has put money into the car then she owns 1/2 if she has not put any money what so ever into the car Only the Insurance, then the car is legally yours unless its on HP.
Ask your G/F for the equal 1/2 value of the car, or the car will have to be returned, but if you signed up for the car then you are obliged to sort out the HP as its in your name, contact your EX & tell her that you are stopping payment for the Insurance but LET HER KNOW, regards the finace, either let her pay you up or send the car back, but let me warn you, depending what you have paid on the car & how long you have had it the HP can ask you to pay.
My advise to you Zack, contact your ex & explain to her that you are going to contact the H.P. Comp that you cannot afford the payments & count your losses, I would also tell your EX the you will be TERMINATING your insurance but make sure you TELL HER, if she decides to carry on with the car that is going to be up to her, I will leave you with this & hope you do the right thing, but whatever you do, do not drop your ex in the SHT by stopping the insurance without telling her. Good Luck.
