To drive a car on a provisional licence without supervision is inexcusable. Whether or not the accident was your fault I doubt that any insurance company would meet the claim under the circumstances and that leaves someone else who was doubtless properly insured and held a Full Licence, to pick up the pieces.
DVLA should have a record of your Licence and I'm sure that the Police will be able to check on this. Have you informed DVLA of the loss?
You will appear before a Magistrates Court and receive a hefty fine plus points on your licence. You may even get a ban.
In my opinion the courts are too lenient on this type of offence. To my mind it should be a MINIMUM fine of �500.
You will be fined and given penalty points but they may be a little more lenient if you are there in person.
The ones who certainly wont be lenient are the insurance companies when you try to renew your insurance.
If you do not receive any more than six points on your provisional licence you can still take the test. If you pass the six points will be carried forward to your full licence. If you get one more point within two years and the previous six are still countable then it is back to square one.
In certain cases courts can issue a ban (on anyone) until a driving test has been passed. In extreme cases they can order you to take an extended driving test which cost twice as much and lasts twice as long as a standard driving test.
Both of these tests can be imposed immediately or following a driving ban.
Youre driving uninsured and could be sued for damage. You say it wasn't your fault but they might say that too.The rest has been said I think. If you've no previous and no one was hurt might not be so bad.Just smile and be very very remorseful.
exactly lyndunnpoet. Bettiboo, whether it was your fault or not makes no difference, and its tough that you are upset by judgements, what did u expect? The bottom line is you should not have been in the car and should not have been driving. It like you getting in a plane to fly it - you dont have any experience or the licence to do so Who let you get in it? Friend, parents? Whoever it was should get a the book thrown at them the same as you. Its mindless people like you that kill innocent pedestrian and drivers.
It was stupid for the other driver to be on the phone, granted, but his insurers will make a bigger thing about you not having a licence.
The police will definately have you for it one way or another. You will not be allowed to take any further driving lessons or tests for some time because you will face a ban and a hefty fine.
