What are the rights of the client when in dipute with the insures'
My husband picked up a brand new BMW 3 series on March 3rd 2006. On March 22nd he was involved in a crash ( causing substantial along the drivers side of the car) for which the other driver has admitted responsibility. Due to the car being less than three weeks old my husband wants to be confident his car will be as good as new when repaired or that his car is replaced.
He has been told that because because he has not agreed to have the car repaired they will not agree to pay for a hire car.
Have you any thoughts.

And surely his insurance covers him for a replacement car.
And lastly,they will not replace the car for a new one,the insurance company will not write the car off if it has less damage then it is to buy a new one.
Most garages insurance companies recommend do such a professional job that I am sure it will be dificult to detect any signs of repair or previous damage.
Once your husband agrees to one of these repairers I am sure your insurance company will supply him with a car while his is being repaired.
When the job is done he will have to sign to say the work has been carried out satisfactorily and if he has a grievance about the repair that will be the time to take it up with them.
your husband needs to chill out. For a start its in the insurer and repair centres best interest to get the car back as close to new as possible. Trust me, even if there is a small bump on a bumper the insurer will request that the whole bumper is changed rather than patched up and sprayed. Anything damaged is replaced.
I dont understand what your hubbies problem is by saying he wants it back as good as new???? What does he expecT? The garage to employ a blind worker using a paint brush to paint the car??? Grow up!
Im not surprised the insurers are not being helpful, when he is acting stupidly and untrust worthy.

My husband is neither stupid nor untrustworthy, he pays insurance for a reason (which we all do) and expects to receive the service from them when required, which happens to be now after years of safe driving without a claim.From your negative comments your sound as if you may work in the insurance business.What do we pay insurance for if not to expect a level of service and support from the company when it is needed (even more so when it is clearly not your fault) as liability has been accepted by the other party.
Not that I have to justify myself to you but for your future reference careless, I do NOT work in the insurance business. I just have common sense, like eveyone else on here.
Yes, we all pay our insurance for peace of mind and expect good service. But worrying about your car coming back looking like new is just simply ridiculous. All insurers will ensure that the best work is carried out, as all repairers must be approved. failure on work will result in the repairer being removed from their approved list, thus menaing a loss of business. Also, unless you husband has his vehicle written off, his vehicle WILL NOT BE REPLACED. Again, another ridiculous notion. Think about it, and it will come to you.
Please do not patronise me, and yes I would expect a new car to look new when returned and why not? Also, I would not expect a replacment car unless the car in the accident was written off, I do not know where YOU got the NOTION from and yes it is ridiculous to even suggest it. I suspect you have not had a car repaired through an insurance claim they are not always returned with everthing working as it should. (I could quote instances) but then again I am sure you would know better.
I am very disapointed in your responses which are very critical to the point of rudeness, I do not see how you think you are being helpful (which is why I asked the question) by your negative attitude.
