A few months ago i left my house in my car and crossed some traffic lights. The traffic then backed up and there was a long queue. I pulled out to the right to see down the line to see if there was somwhere i could turn around. I had checked my mirror prior to this and there was nothing coming from behind. On moving out a motorbike collided with me. The driver was ok, he suffered minor cuts to his hands but stood up immediately, when i asked he said he was ok. Admittedly i know i was in the wrong here, though i am sure the bike was travelling to fast for a 30mph zone. I am due to attend court very soon as i have just recieved a summons for driving without due care. Assuming that i plead guilty what do you expect the punishment to be? Fine and points?? Ban?

If you checked your mirror and there was nothing coming, then how in god's name did you hit a motorbike?

So basically, you didn't check your mirror.

And now you're trying to get out of it by saying the motorbike was doing more than 30? Have some dignity and confess to the crime for heaven's sake - you could have killed the guy!

Hi Mamjet, i didnt come here for you to tell me i'm a liar. Why would i lie, i dont even know you? If i cant say what happened and expect people to believe that i'm an honest person asking for advice then whats the point in posting on this site? I admitted i was in the wrong even though i was stationary at the time the bike hit me, so how am i trying to "get out of it". I was just asking what to expect. You think i go around mowing down bikers in my spare time? No doubt you are a biker or know one and are getting a little bit emotional. Maybe you should leave it to people that can see it for what it is and not get carried away.

Thanks in a pickle. I wasnt passing blame i know it was a stupid manouvre for me to do, i just didnt understand how the bike got there in the few seconds since checking my mirror and moving out. I guess there are blind spots. I guess only he will know if he was speeding but you are right it wont help to even mention it. Thanks
From the Crown Prosecution Service website:

"The maximum penalty is a level 5 fine ( = �5000). The court must also either endorse the driver's licence with between 3 and 9 penalty points (unless there are 'special reasons' not to do so), or impose disqualification for a fixed period and/or until a driving test has been passed".

In practice, 'without due care and attention' usually results in something like a �250 fine + �50 costs + �15 victim compensation scheme payment + between 3 and 6 penalty points.

I would put it down to learning a lesson to be honest Hudskov, it could have all been a lot worse lets face it. Whatever happens, you live to see another day and so does the poor bloke on the motor cycle.
..if he hasn't died since from internal bleeding or something...

Morning Mamjet, you got nothing to do with your sorry self today? I already told you he is fine. I do feel sorry for the bloke, i only wish it was you instead you loser. He seemed quite a nice bloke, you on the other hand need to get a life :)
I would suggest that it is partly your fault but also partly the fault of the motorcyclist who was also showing undue care and attention.

Had he been riding at a speed and in a manner suitable for the prevailing traffic conditions, he would have been able to stop or manouevre in time to avoid or lessen the effect of this incident. He has a greater field of vision than you.

How often did you check your mirror before pulling out? If it was honestly more than once, you can mention this. You took reasonable steps to see if something was coming.

How quickly did you pull out of the traffic queue? If it was quite slowly, then again I contest the motorcyclist is partly responsible.

Whilst I am not saying that you are faultless in this, I also believe that the motorcyclist is likely to be partly responsible and that the burden should be shared.

Also have you already admitted that you are wrong to anyone? If you have that makes things awkward. Insurance companies advise people never to say they were wrong and never to say sorry as it may be construed as an admission of guilt.

I agree we all make mistakes, but not all of us nearly take a motorcyclists head off by not looking in their mirrors before starting dangerous maneouvres.

Bless you Ramjet, i'm sure you have never done anything wrong in your life. There's a lot of love for you out there as we all like to laugh at an idiot, it cheers our day up to know there is somebody worse off than ourselves!
well, there's a motorcyclist with brain damage who is worse than all of us, or are you forgetting that?

but you're right, of course. feel free to get back in your car and continue to terrorise other road users. no doubt when you have your next crash you'll have "looked in your mirror but there was nothing there!" such a great excuse.

Oh come on dearest Ramjet, you can do better than that surely? So those cuts to the hand can lead to brain damage now can they? A doctor too are you? I think not my stroppy friend. I would be inclined to say that you are the one with brain damage as your answers to the questions on this site are purely to try and wind people up. You have no actual knowledge at all on any of the subjects, this is clear from your replies. Fortunately i myself enjoy conversing with you as it amuses me to find somebody with so little content in their life that they have to get their kicks by trying to upset others. It a sad world out there for lonely simple folk like you Ramjet. Try taking up a sport or joining a club, you'll get much more out of it than you do with the little power trip you seem to get on here.
do you have x-ray vision? so how do you know what damage you might have done to his innards? There are lots of cases of people walking away from crashes and then dying (god forbid) from complications later - and you're the one asking me if i am a surgeon? No, I'm not - are you? I'm just a concerned member of the public that has seen enough accidents involving motorcycles to know that they usually come off worse.

Hi Ramjet, you really should learn to take a joke. You are far too angry and serious about life. You never heard of Roger Ramjet? Look it up cos thats what it sounds like. Not suprised you tried to pull the race card on me though given your track record, who's the victim here? The motorbike rider or you? You really are willing to stoop as low as possible to try and upset somebody arent you. I'm aware of the high risk of fatality with motorbike accidents but i already told you this was months ago and that the driver was just fine. You seem to have a selective memory. I'm thinking the driver of that bike has less brain damage than you, you're a very forgetfull person. Though it must be hard to remember all the arguements you have on this site due to your ill informed comments.

I sleep just fine at night Ramjet, though i'm sure you'll be sat awake plotting who you can upset tomorrow.

Seriously though, anger management classes might do you the world of good. Trip to the quacks might help also. You're blood pressure must be very high :)

you said the rider said he was fine. now you are saying he WAS fine. there is a difference. please refer to my last message. we are not all doctors.

if you didnt want to hear someone that disagree with you, why ask the question? why not just ask your mates in the pub? Remember not to drive home after drinking though, youmight cause yet another accident.
