how do i dispute ownership of a vehicle throughthe small claims court?
my ex partner is refusing to give me back a car that i purchased, due to the fact i no longer wish to be in a relationship with him. I purchased this vehicle, as i cannot drive due to partial blindness, when we moved in together, as he is a licence holder & i was having issues transporting my children to & from various hospital appts, docs, schools etc. we agreed i would buy & own the car & he would be the 'registered keeper'. this is the 2nd vehicle ive purchased, i also paid for all parts/ repairs/ fuel/ MOT. Having never been in any debt prior to our living together, and it steadily mounting up since the purchase & as i was struggling to maintain all the costs involved, we agreed to sell it, my ex partner had no income, other than state benefit, which he would squander the same day as receiving it. When i finished our relationship he refused to give me the car, claiming he was the owner! this is to spite me. i have had the police involved, but, as it is a civil matter, they cannot get involved. i understand that for them to cease the car, they need to be able to arrest him for driving without owners consent. they have said i must go to court & get a judge to rule there is a 'disputed ownership'. PLEASE CAN SOMEONE ENLIGHTEN ME TO THIS PROCESS???- im in dire straits over this, any loss of money to me, is a massive impact on my children & i feel this whole process is so unfair- ive always been a decent person & ive been bled dry by a con artist :-(
