you come up to a junction on a side road you are driving on, right on the corner a car is ilegaly parked blocking you view on to the next road so you cant see what is comming. You move out slowly to try and see if anything is comming, a car comming up the other road at a sensible speed but hits you as he cant see you for the same reason. Who would be to blame. You, the other driver, or the owner of the ilegaly park car that has blocked the view of both of you, and why do you think this.

YOU are to blame.
I agree with Norm.

You definitely can't blame the parked car, and the car on the main road has right of way. It's your fault for pulling into its path when you should be giving way. Not being able to see properly is no excuse.
You are to blame if you are turning into traffic, end of story. You cannot blame any obstacle regardless of it's legality.

All 3 guys are right, you would be to blame BUT there is case law which does take into account obstructing vehicles due to parking.

I will try and find out whaich cases.
I can understand the point that if you are joining a road the onus is on YOU, but how can you go about, practically, pulling out onto a road when your vision is obscured ?

I face this situation almost every time I go out in my car. I edge cautiously out, nosing slowly out into the road hoping that if the front of the car is seen by another road user, they will alert me to their prescence by judicious use of their horn, but there are people who travel down this road at a fair lick.
