One of my favourite cd's (tom Petty greatest hits) got stuck in my car cd player. Would not come out and was subsequently scratched so now wont play.

Am I legally allowed to download the tracks of this cd and make a new one? or am i supposed to go out and buy it again?

Obviously I still have the box and covers from the real cd

Strictly speaking, you are expected to buy it again as you have broken the one you have.

I suppose it's like breaking a vase then expecting a new one to replace it for free.

Squarebear you are wrong. Dinsdale, as long as you keep the scratched CD, you can download the album from anywhere, including P2P networks. It's like buying a CD and making CD copies; as long as you keep the original, you can own copies. The original CD acts as proof of purchase.

Whie many people do this, it is illegal to copy a CD once you've bought it even for personal use.

However, many people (myself included do so) and it's unlikely that the record companies will prosecute.

The attitude of copyright holders tends to focus on the multi-copy merchants who are turning piracy into an industry.

One-off individuals, which is most people, will never be chased or caught, it's simply not worth their time and effort.

Since you have the very wonderful taste to enjoy Mr. Petty's works, I'd copy your CD and don't worry about it.
