Some folks may recall me talking about a girl, one of our tenants that i was spending some time with, it was a bad idea and i bailed out. Unfortunately i realised that the bruising on her 4 year olds face was not due to the rough and tumble she claimed it was. My son lives above her and he said that he could hear her screaming at her son for hours in the morning with the kiddie screaming help, nearly every day this happened, i have even got a recording he made on my phone that i cannot bear to listen to. I reported her to the social services and the police, nothing apparently was done. Then she does a runner saying her life was in danger and had to go to a refuge, so the police were involved and the social services, now they are asking if she can have her flat back as if nothing has happened! What the f. is going on, i have given statements, other people have witnessed her leaving the child alone all through the night, now the social services are saying we are at fault for evicting her, she took all her things with the assistance of the police etc. and left!
We can do nothing to stop her coming back or we will end up in court, and the kid is being assaulted still, of that i am sure. Bleeding nutter!

Apeak to social services again. If this child is in danger it needs HELP. Tell them about her leaving the child home-alone on several occasions. Does she live alone with the child?

I have done all this they are supporting her somehow, why has she not had the kid taken off her?
Can you not occupy or get some one to occupy the apartment? Possibly you could say when she left
on her own someone else moved in because hey need somewhere to live. After all you didn't put her out, or did you?

we didn't put her out she just up and went with the help of the social, they say we have to give her 1 months notice even after she left, and the housing ben. stopped being paid. The social asked if i had changed the locks! I can't believe it.
Was the rent still being paid after she left the flat? If so then you may have to allow her to move back in,if it wasn't you could claim she was in breach of the tenancy agreement and apply to have her served with an eviction notice. As for the abuse and neglect of her child you should contact the police,NSPCC and Social Services with the information you have and the recording.

The note she left said the hb was being paid until 27/3.The council said it stopped when she left.
I have reported her to the SS and the police, they are doing nothing, i will go mad if she gets back in. She is in arrears with her rent as well. Who cares, the SS don't, the school should have seen the bruises, i have told the cops. Waste of time.
Take out a few boards, put some scaffle and paint cans in the appartment and say you are renovating the apartment. Then you stall on the work and say you are out of money to finish the job. Some tennants can be a pain in the butt, I feel for you.

We are set to lose whatever, if we make the flat unusable, then no rent from it, if we don't she can get back in, if she wants to withold the rent it will go to court and she will be given time to be rehoused. These flats are 4 months old and already this.

re the month's notice, thats ridiculous, isnt there a loophole or something whereby you wouldnt have to give such notice? eg the violence or something?

does the fact that she 'left' not negate the notice period anyway? she voluntarily made herself homeless after all.

Yes but the social services took her away and if they haven't got her kid taken off her then they will be looking to keep her housed as if she is the victim here. I just do not know what to do. It is a good job she is not a bloke, i would have sorted it out by now. Believe.
Do they really "give" brand new flats to people on benefits? Or is it just private rental and she gets housing benefit? I'm just curious, as I've no idea how it works.
I think the child situation takes priority over any money matters though. Call childline, pester the SS, something has to be done, and SOON, if your suspicions are fouded.
Won't you rather lose a few months rent to be rid of her than to have her back? It's tough and might be costly but life 'ent easy. Making the flat unlivable would be just for a time; you will not be doing major damages to it, just make it look a bit messy. Within a month or two I'm sure social services or even she would fine somewhere else for her to live. Good luck!

They give any accommodation to anyone that qualifies for housing benefit, we can get any amount of tenants, she seemed like a good bet initially. I should not have to repeat my claims to the SS, not unless they appear unfounded, but they have not asked my son or the other tenants for a statement, so they have done nothing.,
dont you tho have a choice whether to 're-let' the property or not? thats incredible, its your property

as Figure says, i would get a friend to pretend to move in or something

She was given a 6 month shorthold tenancy, we would be in breach of that if we moved someone else in, even if she doesn't pay. It could be sorted out later that she owes, but she has no money we would get nothing from her anyway.

Have a word with the CAB and I think perhaps an appointment with a solicitor may be a good idea just to get more information of your legal rights.

We have a solicitor, i know what position we are in, it is the SS that confound me.
