If a married couple, who are 18 and 17 years old, are in a car, and both smoking ... the 18 year old is committing an offence?

That has been the law "down under" for a while now.
Not sure the police can enforce it, but, if people cant understand how their habit is affecting young people they need their butts kicked,"big time".

Minty, but that has always been the case, but no law stating that you cant eat, Sorry, not being pedantic, I just wasn't sure if the law had changed.

Its a bit like driving with one arm out of the window, Ive always done it and most likely always will, a policeman has never even mentioned it.

As for the smoking with kids in the car, I dont suppose the Police will be actively pursuing it, however if they stop a car for any reason, and their is someone in the car smoking with kids in the car, they can the be prosecuted, I dont think that will be much of a drain on Police resources.

They claim if you are eating or drinking you are not in proper control of your vehicle, but a blanket decision like that is ludicrous. Folk can multitask as long as the combined tasks are not requiring more mental capacity than the driver has. Taken to it's logical conclusion one would not be allowed to scratch one's head whilst driving, or even glance in the rear view mirror as that means one is not focused on where one's going. Common sense needs to be brought back and not considered something from the past.

sad that it is necessary to stop smokers gassing their own children. That's how selfish they are. As for enforcement well they'll do what they do with seatbelts, mobile phones etc, they'll catch some most will get away, many will be deterred. Though I'm shocked that smokers do not consider the comfort and health of their own children a priority, or do they think their children like the smell of superkings?

after the children act 1989 I pointed out that a child-mother could consent for more for her child (medically) than she could consent for herself
and I was told not to be stupid ....

however under RIPA ( convert surveillance powers of police ) a senior officer can give permission for surveillance but CAN'T give permission to himself ( R v Norman )

One more step in in the bid for the state to control almost everything we do, in this case it is called 'Health Fascism'.

Just like making the wearing of seat belts and crash helmets compulsory, these are only for our own protection, but tobacco is harmful to everyone, so why don't they make the smoking of tobacco illegal?

What next the closure of all fast food outlets, because we all know that food is not good for both ourselves or our kids?

Incidentally I am a non smoker who supports the right of others to smoke a perfectly legal product.

The state does not ban you from trying to kill yourself (smokers, obese, uncontrolled diabetics, alcoholics etc) advice, yes but banning one ..no.
However it does feel that it should step in when it is clear that one's habits are endangering the health of others.

Latest figures show 17% of the population are smokers now, but over 80% of prisoners and those confined to mental hospitals smoke ! Does this tell us anything?
