Why the constant criticism then?

I understand the reasoning behind it and the good intentions, but as I said earlier, rather than absolving the accused from blame, ‘pardon’ implies that a crime has been committed and the culprit ‘forgiven’. Of course in this case, under the old law, a crime has been committed, but in light of current thinking we now understand that the law was in error and, in retrospect, that particular crime wasn’t really a 'crime' at all. Therefore why 'pardon' rather than simply 'absolve'?

and it has just failed at the first hurdle
