Nailit, it does give hair cutting as an example of bodily harm in the swathes above- and also the psychological harm. It's part of the definition of it.

Just seems to me that times have changed as to how certain catagories of offence are now defined.
I don't know how long abh has been defined like that or whether it has changed, tbh.

he was even made to sweep up his hair while onlookers laughed.

This seems to be well within the ambit of the charge.
Maybe he should of got a greater charge as he used a weapon
Awful experience for a young child, at least the accused pled guilty .
Considering he won't serve anything like 8 months I think it's reasonable.

Nailit, your mind is part of your body therefore someone who adversely affects your mental health in a deliberate act is guilty of ABH, because you have actually been bodily harmed by their actions. Personally if that'd been my kid I'd have beaten the obnoxious bullying twonk into the middle of next week, so I think he's off lightly with 8 months.
A case went to the court of appeal a few years ago. A girl had had her long hair forcibly cut short. The defendant's brief argued that since hair was essentially "dead" tissue no "Actual Bodily Harm" could have been suffered. He was unsuccessful.

a few years ago - a lad cut off his ex girl friends hair whilst she slept - and the magistrate ruled he had not case to answer. Appealed and which ever court it was said he DID have a case to answer - hair was part of you. Six months in the slammer I think

As said this was done as a 'punishment' so it was a clear case of common assault. 8 months is an appropriate sentence under the circumstances.
Reading it again, I see it was ABH, so 8 months is lenient.
The clue was in the sentence, Eddie. Common Assault is a "Summary only" offence with a maximum penalty of six month's custody.
