He may have tried to steer away from a court case, and has been unsuccessful.
Because of time and finding concerns, I believe the CPS only take to court cases which they believe they have a realistic chance of winning.
That suggests that they feel the evidence was strong enough to secure a conviction, but tragically, it's all academic now.
