The meaage it sends to me is that the judges are making an unnecessary protest against the Home Secretary. The Home Secretary apparently wrote to the judges asking them to bear in mind the guidelines that advise (not instruct) them to only send the most serious offenders to prison. They were not his guidelines, but originated within the legal profession. He did not change the guidelines or seek to do so. Many people think that the action in sending the letter was, at best, clumsy. The judge in question apparently saw it as an unwarranted intrusion into his responsibility, and set the prisoner free to make a point. If the guidelines had been followed, the prisoner would have been imprisoned. The answer is that politicians should keep out of the courts and judges should keep out of politics.
