my son is being charged with racial abuse at a football match apparantly one steward reported it to the police, he said that he did not say what the steward said he said but he is still being charged will this stand up in court my sons word against the stewards if there is no other evidence ?

The first consideration will be made by the Crown Prosecution Service (CPS). They will decide if there is enough evidence to bring charges.

If they believe the evidence of the steward is strong enough they will authorise the charge and it will be for your son to defend that charge in court. It will be for magistrates to decide whose story they believe, but to convict they have to believe the steward�s evidence over that of your son beyond reasonable doubt.

If in Scotland it won't stand up. There must be corroborating evidence and in this case it appears that there is only one piece of evidence - one stewards accusation.
