What can i do to save my home? Part two of two

I now have to wait up to a full year to go to an independant tribural to prove my disability. I also applied for DLA as even now i have some difficulty, not as much before injection but enough to still have my wife help wash me everyday. Even though on a recorded telephone conversation with dla staff whom told me that i have to apply describing my pre-epidjural condition, as the injection is masking my true condition. i had a phone call today in which i was told that it counts on my condition of living NOW. so they are going to write to my physio and i have to wait but it seems like i going to get screwed again. so this leaves two options.
one do i continue to take all medical treatment (epidjurals, tablets, physio etc ) and continue to work part time and PRAY that we dont lose our home, or two REFUSE all medical treatments on the grounds of disablilty discrimination let me back get to its original condition or worse as predicted, and then be deamed unfit for work for life. dont get me wrong i WANT TO WORK even part time, which i thought was what the people and the government want for disabled people to work, but when some forigners are getting rediculous amounts of benefits and even mansions, and im getting told no all the time, why should i keep my morals and want to work. If i dont get the help that, according to CAB say i am entitled to and qualify for, and i lose my home what reason would i have to work?.

I can really sympathise with you on this. I had an accident a year or so ago and have had hardly any financial help at all during this time. The situation I am in now is ridiculous. But no way as serious as your own. I would not advise you to give up treatment as it will effect your quality of life so much but I can understand your reasoning for thinking about it.

I cannot really offer you much advice on this situation as you have already dealt with CAB and they would be the first port of call for me also. All I can suggest is to keep badgering them. I cannot see why you have to wait a whole year when your situation is as serious as it is - it's disgraceful!

Have you had a medical exam from the DLA yet?

Maybe a letter to the local MP or newspaper may help shed some light on your situation and might get you some additional help or fast track the outcome for you?

I hope you get sorted out soon and your mind is put at ease. I am sorry I cannot offer more advice but my experience has been a very slow process with a lot of head banging against the wall and many people telling me different things. You just have to stick with it and hope it gets sorted soon. I personally would be on the phone and writing very regular and demanding they deal with you sooner because of your situation. I know there are other people out there in similar situations but if you are close to losing your house something has to be done!

It's clearly terribly difficult for you & you seem to be coping remarkably well given your problems. I'm sure many people with the disabilities you describe would simply not be able to work at all.

So far as the DLA is concerned I guess you'll have to wait & see what decision they come up with. If it is not satisfactory you can (& must) appeal - but again it takes time. If you can, talk to your physio & make sure he/she understands the importance of the way they answer whatever the DLA people put to them.

The wait for the IIDB tribunal seems far too long - perhaps your MP could take this up for you.

It may be too long ago, but is there any possibility you could make a claim against your employer as the accident occurred at work?

thanks 4 your answers, greedyfly no i havent had a medical yet but from what i got from the phonecall i wont be suprised if it didnt get that far. With your suggestion i have sent a three page letter to my MP and asked for his help.thanks. themas, i phoned my physio and she said that she has read the reports by a previous physio whom left just before my injection and hes put i had alot of pain and problems. but she said that from previous experience of these requests from benefit agencies they only want to know current conditions. but as she has been fully aware of my problems and the fact i was mis diangosed at the start she says that she will send a copy of all my previous reports highlight the problems before and the help that she and the injection has done since. she also agrees that it is wrong that i having to fight for this and she will help as much as she can within the rules.
I did take legal action againest the employer in question a couple of years after the accident but because i was not scanned or had any tests i only won £4k. in which i used £1200 to buy a special back supported bed. The reason i got only £4k was because i did a no win no fee with the accident group but they folded during my action, so it was that or nowt.
i have been having really screwed up emotions over the last few months, sad, anger, depression, fear, frustration, resentment, embarrasement, with worrying over money, the house, my back problems, work, and my wife is being dragged though this pile of house menure with me. as i said before i really do want to work. tomorrow i am going to phone the jobcentre and see if they can help me get a job at a supermarket as a till operator in which you sit down, then maybe i could go back to full time work and not have to worry about all of it...............
