Hello to all, i was just curious about a guy who has beaten up a guy i know using a basball bat, resulting the victim into going into hospital with head wounds and a broken jaw. The attacker has also been harassing another friend of myn his x misses, beating her up and also going into her school with intent to smash up her car, which fortunatly wasnt here, The poice are looking for him as we speak, but i was wondering if he would go down for this or not? and how long for? thanks in advance

The maximum penalty for GBH with intent (triable only in the Crown Court) is life imprisonment, for GBH without intent (triable either way) it is five years imprisonment and for ABH (triable either way) it is also five years imprisonment.
Don't for one min think he'll get maximum sentences!! unfortunately it's rare. It will be a long drawn out process and the victims will be dragged through the mill. I hope they go through with it though, scum like that deserve all they get. x
I think this case would be handled by magistrates and they tend to decide the punishment using a criteria. I'm not very familar with it but use of a weapon, unprovoked and two counts of GBH are all factors that would contribute to the severity of the punishment.
GBH usually results in community service but this case could give a prison sentence. I think magistatres can only gove a maximum 6 month prison sentence, or 250 (ish) hours of community service. Of course, the case can be refered to a higher court where a judge will be presnt which means a greater punishment can be issued.
