Information on underage sex?
I wasn't sure what to write int he question box but I'm doing some research about underage sex and we've been given some situations. One of mine is:
A girl one week before her 16th birthday is at a friends house - she has become quite close to her friends dad and has told him some personal stuff about her past and she feels she can trust him. They all have a little drink and the girl and the dad are sitting on the sofa under a blanket - they begin kissing and she pulls his hands down her trousers. A couple of minutes later someone walks in and they stop. Nothing else happens between them apart from talk every now and then. However it is a few years later and the person who walks in is a bit stressed at what they think could have happened. Both the girl and the guy are fine with it and put it down to a mistake.
We just need to find out as much as we can about what would happen if the person who walked in was to say something to someone? Would there be a court case? Could the guy go to jail? Because she was only just off her 16th birthday and are both ok with it will it be alright? If neither the girl or the guy want it coming out, as they ok with it, can someone else like the person who walked in go tell the police and the police start up an investigation?
Any answers would be great - or any advice on where I could get some answers?

At the time she was almost 16....if the police were called straight away I think they would treat her as a 16 year old, take her side of the story and leave it at that.

The CPS have a public interest test on prosecutions
I know you're just talking about kissing but
That public interest test gives them considerable discretion in cases of unlawful sexual intercourse between the ages of 13 and 16 see here:

It's very rare for cases to come up when someone is 15 - I'd really only expect it to happen if there was an issue of abuse of trust such as a doctor or teacher or if the person was mentally deficient
