Can A Neighbor Park His Car In Front Of His House 24/7 To Prevent Us From Getting Motor Home Out Of Driveway?
We are the last house on a dead end, a gate is at dead end that opens to our acreage. There is white driveway stone to show further access. Neighbor across the street has been haressing us for 4 years from getting our motorhome in or out of our driveway which is 20 feet before the end of road. He has parked up against gate, in front of his house, he refuses to move car for me to get motorhome out and know he will completely block me if I get it out from getting it back into driveway. I have taken him to mediation with him signing agreement that he will not block motorhome, that lasted 2 weeks. I have taken him to court with a lawyer, he agreed not to block our RV's and cease doing 2 other charges I had on him with me dismissing the charges. Two weeks he block this gateway from me getting other RV through gate. I called the police and they said they can't do anything about it cause he was legally parked in front of his house. The town owns the roadway 30 feet by 24 ft wide in from gate, my property is surrounding this litte area they town owns. I showed police letter from lawyers showing of this agreement and was told I would have to go back to court. I pressed charges on harassment, neighbor refuses to move vehicle and I am unable to get either RV out from gate or driveway. I can't take the motorhome out of the driveway in the other direction since it is uphill...with overhang in back my driveway is uphill the tail end rips into the driveway, the town sewer line access to my house would get run over and there is a sharp curb I would have to drive over. So the only way out is in the direction towards our gate. I meet with the town today looking for help which they claim that nothing can be done. I need help!

I'd go further than hc's answer and suggest that if you possibly can - move house. We moved at the beginning of the year after trouble with our neighbour and the minute I walked through the door of the new place it was like somebody had cut a huge knot that had been bunched up inside me. You already know the mediation agreement isn't worth the paper it's written on and that there is no point trying to reason with an unreasonable person so instead of wasting more money on lawyers to try and change his ways, just find yourself a better place.

I have to agree , if he just will not give in no court can do anything , they are not going to put him in jail over a parking dispute. i would look to find another place to park the motorhome.
Just a question, you talk first about the motorhome but then go on to mention another RV how many vehicles do you have? Also, on rereading the question you say that he lives '' across the street'' but he blocks your drive and gate by parking outside his own home . I do not understand the full situation. is your motorhome so large it needs the entire width of the street to get in and out of your drive ?

This is a narrow street, other neighbors park in their driveway. I need to pull motorhome which is 34 ft out of driveway to my left, I need to squeeze through gate the town had us put up to conceal it so I am stuck with a wide swing...about 5 ft from the curb across street. If there was another 10 ft before gate it would be no problem. We also have a travel trailer which he blocked gate the moment he saw us hooking up travel trailer to move it. Had the town zoning officer, police trying to talk sense into this nut. My daughter paid for a site, she and her family uses for a getaway at the campground. If she can't afford another year we will need to return it to here. We want to sell the house and live in travel trailer till we know the area we pick to live is good.

Why can't neighbours be more tolerable and cooperative, how awful to live in that situation, where we live neighbours would go out of their way to help everyone. Why would someone be so spiteful to prevent access. Have you talked to your neighbour and asked what the problem is, do you think your mobile home maybe is blocking their view.

His first wife left him and now I see why and he just married his second wife who is from the bad part of the city with a mouth like a truck driver... actually probably worse.

I think your attitude is odd, without siding wth your neighbour however, cos' accrimonious neighbours' disputes are a pain in the neck for police and courts and others.

We purchased our RV's 2003, got layed off 2009, with my age I had to settle for warehouse job at half what I was making. Want to sell house and live in travel trailer so we don't have to make any hasty decisions on next home. Want to keep motorhome to continue our adventures once things get better. RV's depriciate...Motorhome is 15 years in good condition, Travel Trailer is 17 years old in good condition. To sell them now we would not get much for them $10,000 to 12,000. To replace them with newer used vehicles would cost about $70,000 plus. They are paid off and we know everything about them... maintenance, and mainly no leaks.
House is to big for us to stay here, kids are our and have their own families. I am not claiming poverty, just don't want to invest more here that won't be needed when we sell. Gate and posts to conceal RV were put in to zoning officers specs 2 years ago. We want to settle down in another state. Oh, by the way, other neighbors have their toys....boats, classic vehicles, and travel trailers all withing 400 feet of us.
I now realise you are in the USA , the laws there are very different from ours and vary from State to State. We can only give general advice. However I am sure you are right when you say he is jealous and all this stems from that.
