People Smugglers Rescued From The Channel.

Two suspected people smugglers rescued from a sinking boat in the English Channel. Boat contained large number of life jackets. Border Force took them into custody and were bailed after questioning. Bailed I imagine means and will never be seen again. What's wrong with this country.

Did it say where they were from originally Patsy? They could have been British.

I can remember years ago a family having to be rescued from a dinghy in Southend. They were trying to get to Kent. There are some daft people about!
I'd be useless at navigation.

This has been going on for years, so I was told 5 years ago by a resident of that area.

To get bail, don't you have to have a proper address. If they are immigrants, how can they get bail then????

You may be able to see from Southend to Kent, I couldn't possibly comment.
The article states they were 'EU Nationals' they may well have provided an address.

No khandro it was Mamyalynne who put the link to the telegraph up. I just read the article in the Daily Express.
Yeah they probably gave Buck House, Buckingham Palace Road.
The only alternative to bail is a remand in custody, that is VERY rare in crimes other than murder, manslaughter and GBH with intent.
There was no viable alternative to bail in this case as the law does not allow remand for this offence.Judges and magistrates can not make up the law as they go along, they can only go by the rules and guidelines.

Magistrates and judges remand people in custody every day of the week for far less serious crimes than the ones you mention. The 1976 Bail Act governs what happens and it says, basically that everybody has the right to bail unless it can be shown that there is genuine reason to believe that they might:

(a) Abscond (i.e. fail to turn up for their next appearance)
(b) Commit further offences
(c) Interfere with the course of justice (in particular, witnesses)

Bail with conditions may be granted to allay those fears (e.g. a condition to stay away from a particular person and/or location if the problem is (c)). But if no conditions satisfy the court that the risk is sufficiently reduced then a remand in custody is appropriate. In particular remands in custody are frequently used for cases of assault committed as Domestic Violence, where it is feared that the accused, if released, may “persuade” the victim to “change her mind”.

There is insufficient detail to say why the court was satisfied that these people should be granted bail. The fact that they may have no UK address (and we don’t know if that is the case) is not, by itself, a reason to refuse bail.
