28 days returns policy

i understand the 28 day returns policy however i just wanted to run this by someone who may have any (helpful) advice?
i bought a pair of converse trainers from JD Sports in manchester on december 21st for my daughters christmas present. i gave her them on the christmas day then i flew back to spain where i am helping out with a relative who is ill, in the meantime my daughter wanted to take them back and change the colour same style size everything untouched - but i had the receipt and they wouldnt do it without - so as i was flying back this weekend i brought the receipt back with me and yesterday (the 28th Jan) we took them back and they refused to discuss it even - it was an out and out NO!!!!! tough/hard luck/not interested in your reasons/excuses........ A POLICY IS A POLICY and 'unfortunately' we cannot change the colour of the converse as its AFTER the 28 days..................so i begged pleaded etc... and it was still a resounding NO!!! i asked for the number for the Head Office to see if i could plead my case and the shop assistant thrust it into my hand and spouted '"wont make any difference"
I am asking here for advice - not things i SHOULD have done or anything else thanks - i just hoped someone might have had a similar experience and can offer a solution? thank you in advance

Consumer protection is a growth industry but it does not include a 28-day return condition for shop purchases, this would have to be given in addition to your statutory rights of the goods being:
Satisfactory quality, accurately described and fit for purpose.
If your Daughter wanted too just change the colour this was probably taken as just...

Am I missing something, TWR? If the items were bought on the 21st December then the 28 days expired on the 18th Jan.
Anyway, I would point out to HO that you tried to return them earlier but the shop couldn't accept them until the receipt could be found, and also stress that it's an exchange so they are not losing out.

i had to dig out my old calender too - cos i thought i had maybe got it wrong? but even if you cancel out 'sundays' and the christmas bank holidays etc.... i am still far off the 28 days to be truthful? but thanks for your answers - i shall ring tomorrow and i agree its not like i want a refund/different size etc.... its just that she already HAS that colour (her dad bought her some., months ago and i didnt know) and she didnt want to hurt my feelings on the christmas day

If you bought them on the 21st then thats well over 28 days. Why do you think they should make you an exception?
I imagine they will include sundays as that is a working day for them
And it is not JD's fault if the OP didnt take the receipt along and/or lives in Spain

Hang on, am I missing something? If you bought the trainers on 21 Dec, by my calculation that means that the exchange period runs out 28 days - 4 calendar weeks - afterwards - which is 18th January. The fact that there are Sundays and Bank Holidays is irrelevant, it's still 28 days, not 28 working days.
Why do you think that you can exchange them outside this period? - why couldn't you just have mailed the receipt to your daughter - or even scanned it and emailed it - so she could take them back herself.
IMO there is no solution, you are out of time. Your being out of the country won't be an excuse - the solution is usually to give the receipt at the same time but in a sealed envelope, in future, in case an exchange is needed.
JB Sports are within their rights - they don't have to exchange in the first place unless the item is defective, but they give customers a month to change their minds as a courtesy.

buy the pair you want... then take the other pair back - within 28 days - using the new receipt...
i also agree with the others - you have no right to a refund, so demanding to speak to head office etc is ridiculous....and i think your tone to some of the people who have answered you is a bit off...

I suggest you do as others have suggested write to the head office or the manager of the store, remind them the trainers were returned earlier which may have been within their 28-day period and your Daughter was told to return with the receipt, this is important as you do not have too have the receipt you have to have proof of purchase. I am sorry hc but I do not know how you would be aware that the questioner knew of these aspects of consumer law, perhaps you will be kind enough to enlighten me?
I have read my comments again in the light of what you have said and see no reason for any changes as I have given a possible reason to change the trainers outside of their 28-day period.
