Household waste disposal

This morning I went out before work to put my rubbish out when I saw a big bag of rubbish which was not mine. I believe it is most likely from the builders who are a stones throw next door on a new building site.
Our bin area is slabbed with a U shapped wall that encloses it on 3 sides, it is outside the front of our house just off the road and is on our land, it has just enough room for our mail box and bin.
I am extremely careful of what and how much rubbish I put out for enviromental reasons as well as the council getting on my back for dumping or putting rubbish out that is not allowed and has to be taken to a waste tip.
I let it go this morning and did not move it or mention it, do you think this will lead to them taking advantage, and putting even more rubbish there, and what should I do if it gets too bad - contact the council? I assume that as the house next door is not build yet they are not paying council tax etc and therefore should be removing their own waste at their cost?
I can only worry as to where their getting their water from!!
