False Allegation
Hi, well where do i start?? Firstly my now ex partner who is a woman (and im a woman) has made a false allegation against me for assault. It all come about when a day ago she attacked me after a row had broke out. I will say it has not been the first time she has attacked me as since we moved in together last year i have been, mentally, emotionally and physically abused by her. I have wanted to get the police involved and have done a couple of times but the first time she convinced them that i was the one who assaulted her but they didnt do anything because she didnt want to press charges and the second time she blackmailed me saying she would mark herself and tell them again it was me and also get my now nearly 2 year old daughter taken off me. She has beaten me up a numerous amount of times since and when i have wanted to tell the police she has blackmailed me with different things and has made me too afraid to tell the authorities what she has been doing. Back to a day ago a row started and she assaulted me, smashed my phone up and called me very nasty things. I tried my hardest to protect myself from any further harm and when she had succeeded in hurting me she just walked off. I gathered some belongings and drove to my relatives, next thing i no i have a phone call from the police saying that she has made an allegation of assault. I am sickened as I have been the victim for many months but as she has controlled my feelings she has always got away with it. Could anyone give me some advice? Thanks

For more on marking an answer as the "Best Answer", please visit our FAQ.Kell, you are being invited to the police station where you will be formally interviewed under caution etc. At the police station you will informed of certain legal rights which includes the right to legal representation. I would strongly suggest you consider the use of a solicitor which I understand is still free of charge (make sure you find out first) and ask for the solicitor to attend any formal interviews.
This allegation falls within the catagory of Domestic Violence and has a 'positive action' policy so it will be pursued. If you deny the allegations and the matter can not be locally resolved then a report is likely to be submitted to the Crown Prosecution Service for a decision which could take a few weeks depending on how busy the police are.
