As we are both non-smokers,and lived in our house for over sixty years is there any new law to help us with our neighbours who smoke but only smoke in the garden next to their fence which is about three feet away from our patio doors,so when thesun is out we have our patio door open and then find we can smell smoke in our garden which drifts into our front room.
I have had a word with the lady next door to ask them if they could go down to the bottom of the garden to smoke but all they have done is to pull there table to nearer their patio door and still smoke,we can still smell the smoke.
What if anything can I do,I have done them a few favours in the past ,all I ask is one favour ?????

im no expert, but if they are on their own property , not sure you could do anything..... ask your environmenyal health dept.

Sorry I meant to put we have been living in our property for over thirty six years not sixty.
Great, another inconsiderate smoker giving the rest of us a bad name! (excuse me while I light a ciggie!)

Sorry, nothing you can do legally, but I can't stand smokers who are so up their own backsides they don't understand others won't want the smell in their houses.

BOO,the boot would be on the other foot if you didn't smoke which I did thirtytwo years ago also my mother died of smoking.
Well, I must admit to sympathising with Doddsredoubt. I would hate it if cigarette smoke was drifting into our front room, but I'm afraid there is not a lot you can do really, except for keep your patio doors shut. Not very helpful is it. I must admit if I was a smoker, I probably wouldn't want to go down to the bottom of my garden if I had a cigarette.

It's not pleasant but there is bound to be something with most neighbours that interferes with the enjoyment of our properties, unless we live with no neighbours at all.

They have, at least, tried to be helpful by pulling their table further from you. But what else can they really do?

I dont think it matters,whether you have been there for 36years or 36mins,you can only appeal to their good nature.
Chuckfickens made an excellent observation.
I hate people who smoke in queues with no regard for anyone stood behind them. I smoke but only on holiday and would never inflict my smoke on anyone purposely.
Some people I'm afraid would do it even more even after you had asked them politely not to.
Your entitled to your opnion doddsredoubt, but as it is, my sympathies are with your neighbours. All they're doing is having a few smokes outside, and they are greeted by a disgruntled neighbour who is probably too oversensitive.

Lets face it, ti'll be too cold wet and dark soon- then you won't have a problem.

Unfortunately, whether you have lived in your house for 30 years or 1 month, it makes no difference to your rights at all in this respect.

Oh dear, why do people smoke? Sorry BOO. But it is a horrible smelly habit and it can spoil other peoples lives, even if we smoke on our own premises.

a bit like food smells there is not a lot you can do about your neighbour smoking outside in their own garden other than shut your patio door.
if i was sitting in my patio with the doors open on a sunny day, and cigarette smoke was wafting into my house, i dont think id be too happy either, are your neighbours new ? dont worry winter be here soon, all doors will be closed.
Just wait till they light a bonfire to burn off all the garden detritus. Then you might really have something to moan about!
Come to think of it. It is rather selfish. They could go inside and shut the door and have a smoke so the smoke doesn't get into your house. But then their house would smell of smoke! If they smoke then that shouldn't worry them.

I agree with BOO on so many things. But not on this. Sorry :o(

Actually if something you do on your own property affects the health of your neighbours then Environmental Health can intervene. But I don't this issue warrants it - not for a just a small amount of smoke from a few cigarettes.
Yeah Cazz, but food smells don't affect your health or wellbeing. Not generally anyway ;o)

The poor buggers moved their table nearer their door to help this guy!

Seriously, i really do think it's a case of the OP being oversensitive in this case. House smells of smoke from someone smoking three foot away...outside? I don't believe it.
