ebay refund problem
i recently purchased two bar stools online that were too short for our new kitchen island we have had built. i bought them on ebay although i was only able to pay by paypal on there so i had to instead call the company the next day to pay by mastercard, 99 pounds 99p. i initially queried the returns policy on their website which states it is 20.00 to return an item. i thought this was worth it if the goods were unsuitable. i rechecked the returns policy first before buying by email and was emailed by a man called denis to say it was 22.50 to return items. i rang denis and i said that on their website it stated 20 pounds to return item. he said that if that was the case then it was what it said.so in effect i was told that to return the goods would cost 20 pounds which i accepted if the item were to be unsuitable. so, i paid 99.99 and was refunded 62.99. i have emailed and phoned to question the refund as too low. an email from someone called pete said the 20 pound is an admin charge if goods are returned to them by the customer ( this is ambiguous, doesnt specify how ie not literally by hand). if the goods collected, he said it is 28 pounds aswell as admin fee, if this is the case i have not been charged enough anyway as i have had 37 pounds taken from the full price of the item and this would mean 48 pounds anyway. these charges are nowhere specified on their website.i would not have entered into this transaction had i known it would cost so much to return. i was willing to pay 20 pounds to return items if not suitable, taking a chance if they were right or wrong of this fee and this fee only. i would like a refund of 79.99 please. an email was sent today 1/9/11 by pete again to point out these charges, But these arent made clear on ebay at all, ie unstated. i am told i dont have Ebay protection as i assume i didnt pay through them. i have opened a case with Ebay which after 10 days escalates, ie tomorrow but i cannot see that i will get my money back. Do you think i have a case with Trading Standards as their charges are not listed on their website or item for sale? i was also told i had to say the goods had been returned etc so that the company, seller, could get their ebay charges refunded. im not sure if this has happened and dont think it should until this matter is resolved. I really dont know what to do next and it is making me ill.

The Distance Selling Regulations applies to ALL sales made over the internet, by phone or post EXCEPT auction sites auction listings.

The DSR states that all purchases made over the internet, by phone or by post are subject to a cooling off period. The buyer must inform the seller that he intends to return the goods within 7 days of receipt. He then must return them as soon as is practicable for a full refund, including outward postage.
The buyer MAY be liable for return postage costs depending on the terms and conditions of the sellerl.
If nextqueen bought these stools by any method except eBay auction listing the seller is in breach of the DSR and should be reported to Trading Standards.

Yes, I am aware of DSR's but the op was asking about a refund via ebay which they wont get
If the claim goes via the CC then BIN or auction doesn't matter either
But it does have to be £100 which this was not so no refund there either as far as I am aware
Trading standards possibly, but they can charge a restock fee should they choose to as it was in their TOS - had it been an eBay sale they would not have, but it wasnt so they can

next queen - regardless of whether you have the actual funds in your PP a/c you can still pay by PP. My PP a/c never physically has funds in it but I use to all the time and not just for ebay either. Many sites will accept PP now. It will come direct from your bank a/c if you have it set up that way or direct from your mastercard
