mp4 is better than mp3, no question. Lots of rippers are available. iTunes rips to mp4 (also called aac) by default, and is very easy to use:

MP4 is not an encoding format - it is a container capable of holding many kinds of data streams including video as well as audio (such as AAC and MP3) and it is the quality of its content which defines the quality of output.

If the MP4 contains a 96kbit MP3 stream it is no better than a 96kbit MP3.
