E bay problems can anyone help please.

Can anyone help me? This is a question about e bay!! I bought an item the other day (Tom Tom Sat Nav) and it arrived in a very sorry state (no fault of postage) it doesn't work and its basically junk. I paid for it by Pay Pal and the seller is being an ******* about the whole thing saying I scratched it etc etc. What should I do? I have lodged a dispute with Pay Pal but they have never been much help in the past so can anyone give me some advice?

Just follow the PayPal timescales for filing an Item Not As Described dispute and you should get your money back.

Did he send it by recorded delivery?

Yes she did, I know what your saying but I have acknowleged receipt of the goods.
Was it advertised as new, or in very good condition?

It was advertised as used a few times and in excellent condition, which it isnt. Its scratched, has a lot of wear on the casing and to cap it all does not even power up. Its JUNK. It was also advertised with no pictures, which I now realise why!!! check the item number:180303037957 on e bay. Thanks Ethel.
You're going to have problems with this one - all he says is 'hardly used'.
He doesn't say it is in good condition or even working.

Fingers crossed PayPal comes up trumps.

Paypal are much better at this than they used to be. I'm sure they'll sort out a refund for you.

you took a risk for a high value item. sorry to sound negative, but I wouldn't have trusted her.

still doesn't mean she won't have to cough up, though!
I've recently been in a dispute with paypal over a counterfeit item and I have found that they make it as hard as possible for you to get anything back. I've been fuming with them. They dont want to give you any kind of help or refund but yet are supposed to be the 'safest' way to pay for things on ebay. Their timeframes are also very unreasonable. It does indeed 'suck'.

Hello ethel. I would still be �94 out of pocket so I guess it wouldnt have made any difference in my case how I paid.

Have you been able to prove the item is counterfeit?
Worst still eastern, they got their 100% feedback by "BUYING" a sim card for �3.00. I know it doesn't help but this would have been a strong warning sign to me

Yes I have. But the information they required could only come from the manufacturer themselves and they could not give me the documentation to prove counterfeit in less than 14 days. Paypal require it to be sent to them within 10. I found it impossible to contact papypal back and there are no exceptions to the timeframe. I just felt that if the item is proved to be counterfeit, they should want to chase this up with the seller anyway.
My beef now, is less that I'm �94 down, and more that there are sellers of such items on ebay getting away with selling things like this. As I suspect eastern will be too. I suppose must just be too gullible but I wont do it again.

Just to update on this thread, Pay Pal came through and provided a refund on proof of posting the goods back to the bandit that sold them! Thanks Ethel for your help and everyone else who contributed
